Reed Performance and Descriptions:

We strive to craft each reed to the highest standards. However, individual embouchures and instrument variations can affect performance. We cannot guarantee that a reed's subjective qualities, such as "hardness," will align perfectly with your personal expectations, even if it meets the standards outlined in our product description.

Product Availability and Stock:

All products and services are subject to availability. We make every effort to accurately display product stock, but items may sell out during the checkout process. In these rare instances, we will notify you to arrange a refund or discuss backorder options. We reserve the right to limit quantities or discontinue products without notice.

Promotions and Coupon Codes

Promotional offers, coupons, and discounts (“Promotions”) are subject to availability and may be limited to one per person, household, account, payment method, IP address, device, or order. Promotions are non‑transferable and may not be sold or combined with other offers unless expressly stated.

We may verify eligibility and detect abuse using order information and technical signals (including IP address and browser user agent). We reserve the right to refuse, revoke, or cancel a Promotion, and to suspend or terminate accounts, if we suspect in our sole discretion any misuse or fraudulent activity (including creating multiple accounts, using disposable emails, or attempting to circumvent geographic or “new customer” restrictions).

When you place an order, you agree to provide current, complete, and accurate purchase and account information. Your placement of an order does not constitute our acceptance of that order; we reserve the right to accept or reject any order at our discretion.

Pricing and Payment:

All prices are in USD (unless otherwise noted) and are subject to change. We reserve the right to correct any pricing errors. Payment must be made in full at the time of purchase. We accept major card services, PayPal, and Apple Pay where supported. By providing a payment method, you authorize us to charge it for the total amount of your order, including any applicable taxes and shipping fees.

Shipping and Delivery

Shipping Times:

We will make every effort to ship orders promptly. However, we are not responsible for delays caused by shipping carriers or other factors beyond our control. Orders containing handmade reeds may take longer to ship, as we are committed to ensuring the highest quality.

Risk of Loss and Address Accuracy:

The risk of loss for all items purchased from us passes to you upon our delivery to the shipping carrier. You are responsible for providing a correct and complete shipping address. We are not responsible for orders shipped to an incorrect address provided by you, nor are we liable for packages lost or stolen after they have been marked as "Delivered" by the carrier.

Account Registration

User-Generated Content

By posting User Content, you grant VGB Music Store a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. TO THE FULLEST EXTENT PERMITTED BY LAW, VGB MUSIC STORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, RESULTING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM THAT GAVE RISE TO YOUR CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless VGB Music Store and its affiliates, officers, directors, and employees from any claims, liabilities, damages, and costs (including reasonable attorneys' fees) arising from your use of the Services or your violation of these Terms.

Dispute Resolution and Binding Arbitration

Governing Law: These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions.

Informal Negotiation: To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms (each a "Dispute"), you and VGB Music Store agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one party to the other.

Binding Arbitration: If the parties are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA"). The arbitration shall be conducted in Kentucky, USA.

Class Action Waiver: You and VGB Music Store agree that any arbitration shall be limited to the Dispute between us individually. To the full extent permitted by law, (1) no arbitration shall be joined with any other proceeding; (2) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (3) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Termination

Suspension

We reserve the right to terminate or suspend your access to the Services at any time, without prior notice, for any reason, including a breach of these Terms. Provisions that by their nature should survive termination (such as ownership, disclaimers, and liability limitations) shall survive.

Promotion Abuse

Any attempt to manipulate Promotions, including creating multiple accounts or masking identity to obtain repeated benefits, is prohibited and may result in account suspension or termination.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, constitute the entire agreement between you and VGB Music Store concerning the Services and supersede all prior or contemporaneous communications.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
